Negotiations Update for April 15, 2010

Dear Colleagues;

At negotiations on April 13, 2010 both the labor attorney for the District, Jay Fernow, and
Jeff Foster, Deputy Superintendent, stated that is in intent of the District to discontinue Medi-Gap coverage for our members, a benefit that was negotiated and agreed to since 2001. (Medi-Gap coverage covers the cost of the premium for a health care supplement for retirees) Mr. Foster also stated that the District has been contemplating this action for "months". However; this information has never appeared in any of the District's many budget scenarios that were presented at the school sites nor was it ever discussed with the AVTA bargaining team.

AVTA learned of this through other channels and attempted to discuss it at our April 1, 2010 negotiations session with the District.
The District refused to discuss this with us.

Furthermore, all
employment contracts for cabinet level personnel in the District include FULLY PAID MEDICAL BENEFITS to age 75. AVTA believes that no group, whether management or labor is more deserving of health and welfare benefits than any other.

AVTA has filed a grievance on behalf of our members and is pursuing all other actions, including possible legal actions, to protect these benefits.

MEMORANDUM OF UNDERSTANDING BETWEEN ANTELOPE VALLEY UNION HIGH SCHOOL DISTRICT AND ANTELOPE VALLEY TEACHER’S ASSOCIATION REGARDING COMPENSATION/WORK YEAR

This Memorandum of Understanding ("MOU") is entered into this ____th day of April, by and between Antelope Valley Union High School District ("District") and Antelope Valley Teacher’s Association CTA/NEA ("AVTA") (collectively referred to herein as the "Parties") regarding Compensation/Work Year. This MOU is only for the 2010-2011 school year. This is a package proposal to be accepted or rejected in its entirety.

Article 3, Salaries and Benefits

The salary schedule for the 2010-2011 school year shall increase the 2009-2010 salary schedule by zero percent (0%). The salary schedule is contained in Appendix A.

The work year for all unit members shall be reduced by four (4) days. Teaching unit members shall be contracted for a total number of days during the regular 2010-2011 work year not to exceed one-hundred and seventy-eight (178) days and new unit members initial 2010-2011 work year shall be one-hundred and eighty (180) days. The 2010-2011 work year reflects four (4) furlough days during the 2010-2011 school year. The furlough days will be taken on August 4 and 5, 2010, on October 12, 2010 and March 8, 2011. The October and March dates will replace the monthly mandatory staff meetings. The unit members' salary schedule will be revised to reflect a decrease in salary corresponding to the four (4) furlough days. For each furlough day, unit members will be compensated at their per diem rate for attendance at professional development as offered by the District. The 2010-2011 calendar will be modified to reflect the revised work year.

Section 3.7 will be revised as follows: In the event of emergencies or inclement weather requiring the closing of school below the required one hundred seventy-eight (178) days of student attendance, . . ."

The District will maintain the cap on the health and welfare benefits ($1,269.12). The District agrees to cover any increases beyond the current cap using any savings between the actual cost of step and column movement for bargaining unit members for the 2010-2011 school year compared with the budgeted projected cost for the 2010-2011 school year of $2,038,000. If health benefit premiums exceed any savings calculated from the above, excess costs will be borne by the individual employee. The costs of step and column movement shall solely be the increased cost for movement on the salary schedule based on longevity (moving down steps on the salary schedule) or coursework (moving over columns on the salary schedule) and shall not include costs or savings from extra period assignments, or furlough days. For the 2010-2011 school year, acceptable units earned during the year may be offered for salary progression to be effective September 1, 2010 provided the unit member submits verification of said units to the Personnel Services Office on or before September 10th, 2010. There will be no column movement based on coursework during the Spring semester of 2010-2011. Representatives from the District and AVTA shall meet no later than September 1, 2010 to perform the aforementioned calculations. Any excess money above that needed to cover the cost of benefits will be used to reinstate stipend reductions and paid on a pro rata basis to unit members only.

Appendix D, Extra Duty Pay Schedule

Decrease all stipends including Athletics, Activities, Counselor Independent Study Stipend (per Appendix D, section 7.1.1) and Department Chairs to 65% of current value.

Contingency Language

If currently projected state and/or federal funding for the 2010-2011 school year increases or decreases beyond projected values as of the second interim report, the parties agree to reopen and negotiate contract articles related to funding, including, but not limited to, Article 3, Salaries and Benefits, Article 4, Employee Workday and Duty Obligations, Article 9, Class Size, Appendix A, Salary Schedules and Appendix D, Extra Duty Pay Schedule.

For the 2010-11 school year, for each 0.5% increase in ADA, as measured between P-1 of the 2010-11 school year as compared to P-2 of the 2009-10 school year, additional funds will be applied first to offset health and welfare premium increases above the current cap, and second to restore stipend values up to their full value.

Any savings realized by the District as a result of the re-negotiations of the LASD contract with the District will be used to reduce class size in Social Science.

Eliminate from 3.8.3.1 "…for which they do not receive hourly or stipend compensation…"
